Thrive Terms and Conditions

Definitions

  • “Member”: individual who is a member of Thrive paying weekly or fortnightly
  • “Emma Bull”: the owner of Thrive and the individual with the right to seek legal action if a member breaches any of the Terms and Conditions.
  • “Us”: Emma Bull and other individuals of Emma’s team.

Team Training Membership Policy

  • Members are required to wear appropriate attire and footwear.
  • Members will bring along any aids required by the member including a water bottle, towel, inhalers (if required.)
  • Members are required to sign in at the start of each training session.

Trainer agreement

  • All trainers will be qualified personal trainers.
  • Trainers will provide safe workout environment and safe exercises.
  • Trainers may cancel or postpone a session. Where possible if the trainer is unable to take a session another trainer or make up session will be offered.

Terms of payment

  • All memberships are to be paid via Direct Debit weekly or fortnightly in advance.
  • In the event of a failed direct debit payment, the member will be responsible for paying any fees incurred.
  • All membership upgrades/downgrades must be done in writing to support@thrivetribe.co.nz and your membership fees will be adjusted accordingly to the CURRENT membership price.
  • We will not change the membership fees without your permission.

Refund and Cancellation of memberships.

  • Memberships are a 12 week minimum.
  • Cancellation of membership requires 14 days notice in writing to support@thrivetribe.co.nz after the initial 12 week minimum.
  • Memberships may be cancelled prior to the 12 week minimum if a medical certificate is provided stating the member can no longer take part.
  • Upon cancelling, you will have full continued access until the date of your 2 week cancellation, from that date all access to will be revoked.
  • Memberships may be put on hold for a minimum of 14 days with a maximum time of 6 weeks. We require 7 days written notice to support@thrivetribe.co.nz
  • No refunds will be given.

Rules of Conduct

  • The private Facebook communities Thrive members is a place of learning, growth and support and it is encouraged to be a contributing member of this community.
  • Members shall at all times act with integrity and respect to other members in both face to face team training sessions and in our private Facebook communities.
  • Inappropriate conduct may lead to termination of membership at Emma’s discretion.

Rules of Use and Intellectual Property Rights

  • Thrive Membership Hub  consists of a variety of video training’s, PDFs and recordings etc. By entering the area through your paid membership, you agree that all the content inside is solely meant for your personal use and you do not have any rights to download it, share it, transfer it or reproduce it unless you have Emma Bull’s written consent. This includes all content from the private Facebook communities associate with Thrive and the membership site www.thrivetribe.co.nz
  • Your username and password should be kept confidential
  • You must not allow any third party to access the site using your username and password and take advantage of the site on your behalf by viewing any of the content.

 Indemnity

  • If a member is found to be negligible of any of the terms and conditions and membership rules, he/she agrees to keep us indemnified of all losses, expenses, damages and costs incurred by us in respect of any misleading statements, and/or acts, and/or omissions that may be carried by him/her against us.
  • All results are the full responsibility of the member.
  • If a member does not get the desired results as part of the membership, he/she agrees to not pursue any legal action against Emma Bull or any other member of the membership community.
  • We cannot be held responsible for whether members choose to implement our teachings and advice, and for whether they implement them in the right way.

Confidentiality

  • To Protect Emma Bull the member agrees not to disclose any information or participants practice, materials, fees or methods to third parties.
  • Emma Bull acknowledges she may obtain confidential personal from the member and agrees to keep such information private and confidential and will not disclose or use such information without the Client’s prior consent.
  • This clause shall survive termination of the membership.

General

  • We reserve the right to alter our terms and conditions. By being a Thrive member, you are automatically bound by these terms and it is the members responsibility to keep informed of any changes, without further notice to you.

Thrive Member Consent

Warning: I understand that in participating in any group training and Thrive’s online Membership, I do so at my own risk and accidents can happen resulting in personal injury. I take full responsibility and ownership of any accidents or injury that occurs during training sessions, live and online.

Fitness to participate: I warrant that I am physically fit and medically sound to participate in team training run by Thrive. I will notify Thrive in writing if my situation changes.

Nutrition: I understand that Thrive are not qualified nutritionist and can only give nutritional guidance. If I am wishing to seek specific nutrition plans or advice I will do so at my own expense.

Medical intervention: I consent Thrive and its representatives to administer or obtain medical assistance in the event of an accident or medical condition I may suffer whist participating in face to face team training sessions. I agree to accept all medical costs or expenses incurred by administering or obtaining such medical assistance.

Photography: Photos of training sessions and screenshots will be taken from time to time. These photos may be used on social media or www.thrivetribe.co.nz website. They will be used with the highest of integrity on these platforms.
